Question
:
Dear QIMR team
Please see our questions below:
1 In the Response Form 6.2 – Schedule 3 Rates (Service Agreement) in the “Additional Charges applicable to this Contract”, what is the difference between “Receiving, reviewing and responding to Office Actions” and “Receiving, reviewing and responding to Examination Reports”? The terms “Office Action” and “Examination Report” are often used interchangeably but sometimes refer to “local” Australian and New Zealand examination reports and “foreign” office actions. Is that the distinction you intend?
2 In the Response Form 6.2 – Schedule 3 Rates (Service Agreement) in the “Additional Charges applicable to this Contract”, does “Receiving, reviewing and responding to Search Reports” refer to the International Search Report only. Please confirm if responding to a European Search Report should be separately estimated in this section and if you are interested in pricing for conduct of International-type Searches and reporting on the International-type Search Report.
3 In the Response Form 6.2 – Schedule 3 Rates (Service Agreement) in the “Additional Charges applicable to this Contract”, are the prior art searches prefiling novelty searches for use to assess the merits of filing a patent application? If you are interested in other prior art searching, please advise the type of prior art searching.
4 Which foreign jurisdictions would you like cost information for? For example, Australia, the US, Europe, Canada, India, New Zealand and Singapore appear to be of interest to you. Are there others we should include?
We look forward to hearing from you at your earliest convenience.

:
1 We intend “Office Actions” to refer to foreign prosecution reports/communications (e.g., USPTO, EPO, etc.), and “Examination Reports” to refer primarily to local Australian/New Zealand Examination Reports. We acknowledge the terms are often used interchangeably.
2 We would like to see pricing for both International and European Search Reports. We will not require conduct of International-type Searches and reporting of the International-type Search Reports at this stage.
3 Yes, the prior art searches are intended to cover pre-filing patentability/novelty-style searches used to assess the merits of filing and to inform initial claim scope/strategy.
4 Australia, United States, Canada, India, Japan, South Korea, China, Hong Kong, Europe.
