Details
The Shire of Mount Alexander (“the Council”) requires suitably qualified, skilled and experienced service providers to form a panel of Contractors to provide a range of Tree Services. Council is seeking to engage multiple suppliers for each category of service. It is not anticipated that each tenderer will be capable of providing all the services specified. Contractors may tender for all or any category of this specification.

The successful contractors will be appointed to a panel of preferred Contractors for an Initial Contract Term of three (3) years. The Council may, at its option, extend the operation of this Contract beyond the Initial Contract Term for a maximum of two (2) x one (1) year terms from the expiration of the Initial Contract Term.

Question:
Is it a requirement for all tenderers to have the equipment and be qualified for electric line clearance, or will Council accept offers from company's who provide all the services and equipment set out in Table A4 but don't offer electric line clearance?

We will consider elevated work platforms (EWP’s) that are not insulated however, we would ideally like 3 contractors at minimum that supply an insulated EWP or multiple.

Tenderers are advised that when filling out the rates that you highlight whether or not your EWP is insulated or not insulated which will assist in determining whether or not a tenderer can be considered for Electric Line Clearance works.

Question:
Do tenderers require employed staff with work cover insurance? Or can they use sub-contractors? Does each sub-contractor require 20m PL insurance and/or relevant work cover?

Tenderers with direct employees (not sub-contractors) must provide evidence of WorkCover insurance (Certificate of Currency).

In addition tenderers must provide evidence of:

- Public Liability (min $20m)

- Professional Indemnity (min $5m) if tendering for arboricultural consultancy services

- Evidence of Environmental Management System

- Evidence of Plant and Equipment Insurance; and

- Evidence of Motor Vehicle Insurance.

The General Conditions of Contract that will apply to successful tenderers outlines the following requirements relating to sub-contracting. In assessing the engagement of sub-contractors, Council would expect that sub-contractors will meet the insurance requirements outlined above.

6. SUB-CONTRACTING AND ASSIGNMENT

6.1 Sub-Contracting

6.1.1 General

The Contractor must not sub-contract the whole or any portion of its rights and obligations under this Contract, except with the prior written consent of the Supervisor, which may be given subject to such conditions as the Supervisor considers appropriate. Except in so far as any consent given by the Supervisor under this sub-clause 6.1.1 expressly provides otherwise, no sub-contractors will have any rights under this Contract against the Council or be entitled to receive any payments under this Contract from the Council.

6.1.2 Contractor still to be Liable

Unless otherwise agreed in writing by the Supervisor, no sub-contracting of any rights or obligations of the Contractor under this Contract will relieve the Contractor from any liability under this Contract or at law in respect of the performance or purported performance of this Contract and the Contractor will be responsible for the acts and omissions of any sub-contractor, or any sub-contractor’s employees

and agents, as if they were the acts or omissions of the Contractor.

A few questions:

Can you confirm the number of trees included in the programmed inspections work and when they were last inspected? Also, can you confirm the tree management system council uses (or plans to use)?

Programmed inspection works - quotations are sought on a case by case basis and tree numbers can be provided at that time.

If inspections are sought, Council will be using Forestree.
