Item 24 of the Annexure Part A to the AS4122-201 Special Conditions of Contract specifies unlimited Consultant’s liability (document 4._P263923_Attachment_3_AS4122_Conditions_of_Contract_(Read_and_keep).pdf).

We note that recent DETSI/QPWS&P RFQs have a specified limit of liability in this item of the Annexure Part to the SCC. We therefore seek clarification on whether the limit of liability is in fact unlimited/uncapped for this specific consultancy engagement. If this is not the case, then requesting confirmation of the limit of liability please.

Good morning,

The department generally requires unlimited liability and indemnity when inviting offers for procurements, however may apply a cap on liability / indemnity if requested by a supplier as part of their offer.

If a supplier wishes to request a specified limit of liability for this contract, please indicate the limit as part of your offer for this procurement activity.

The Josephine Falls Upgrade project is a mix of Government Building Assets and Government Non-Building Assets. As the Government Building Asset component of the project is not anticipated to exceed the threshold noted in the Building Policy Framework, PQC registration is not required for this project.

Question:
Clarification Request – Site Visit Allowance

Section 2.6 of the Project Brief states that all transport and accommodation costs to / from the Superintendent’s office / base to the site are to be included, and that a total of six site inspections has been allowed for throughout the construction phase.

Could the Principal please confirm whether the six nominated site inspections are intended to represent the total site attendance allowance to be included in the lump sum fee for the construction phase?

Could the Principal also confirm whether attendance at the project kick-off meeting, Practical Completion inspection, defects review and Final Completion inspection is expected to be included within the six nominated site inspections, or whether these attendances are to be treated separately?

This clarification is requested to ensure the proposed fee accurately reflects the expected site attendance, travel and accommodation requirements for the engagement.

Good afternoon,

Could you please provide some clarrification for the below questions:

• Cl. 2.4: reference is made to contract P263855 which is understood to be the contract number that the contractor will be engaged under. Please confirm.

• Cl. 2.4 AS2124-1992 is the contract being proposed for engagement of the contractor. It is noted however that this is a construct only contract, but the scope in the same table outlines a number of design priorities and obligations. Please clarify if the engagement of the contractor is to be construct only or design and construct.

• Cl. 2.5: Project Documents: please provide a copy of all referenced drawings and reports.

• Cl. 1.2 & 2.4 shows that contract P263855 (for construction) may have been tendered in early June, with the tender close late June with contract award expected July 2026. It appears as though the construction tender is running in parallel with the Superintendent Request for Quote process. Please confirm this assumption.

• Cl. 2.2 requires that the superintendent participate in the tender and engagement stages- being involved with RFI’s etc. during the tender period. We note that P263923 - Josephine Falls Upgrade – Superintendent Services Request for Quote was issued 06/06/26, and will be returned 18/06/26. Please confirm the expected engagement timeframe of both the superintendent and contractor. if the construction tender has closed before the superintendent has been engaged, please clarify how the Cl. 2.2 services are to be met.
