My name is Stuart Galligan and i am the Managing Director of Splash Pool Care Qld Pty Ltd. We currently deal with a number of commercial customers that hold facilities between Bowen, Whitsundays, Mackay & Surrounds. We also deal with Councils and their venue managment partners directly.

I am hopeful to arrange a time to view each of the facilities and the chemical storage on site to understand the logistics. It would also be good to speak with the individuals who run those facilities on a day to day basis so we can zero in on their challenges.

We know we need to sumbit competitive pricing but often, with some discussion we can offer direct improvements or alternatives that may result in an improvement.

It is our understanding that Prolink is not available in Australia at this time and we would need an alternative. Metalarv is one option. If you are able to provide something the same than please add to the list with an explanation.

Question:
Council Estimate Annual Usage is unknown for Pest & Vector Categories? It makes it hard to source best pricing without being able to provide estimate for stock hold and replenishment.

Question:
Can I have more clarification on the below clauses:

• 10.4 (c and d) we need to provide the council with any warranties available for the relevant goods from the relevant manufacturer. (Manufacturer warranties).

? Since we are not the manufacturers but the distributors, therefore need more clarity on what Council intend with this. If it means get replacement product from the manufacturer (through us) then we are OK with that. But holding the manufacturer directly liable and directly go after them is not the case?

The manufacturer will not allow this. The council buys from us so we are liable, and then we will have some form of recourse to the manufacturer.

• For clause 29 can we exclude and replace with the following statement: “The Contractor shall not be liable to the Council for any loss of profits, or for any indirect, special or consequential loss or damage, unless arising from their fraudulent conduct or willful default. The Contractor’s liability to the Council is limited the total amount of Price paid by Council to the Contractor during the Contract Term”.
