Question
:
What insurances are required from both parties?
How will damage to land be assessed and repaired?
Answered on 10/Oct/2025 10:20 AM
:
Insurances required for any lease of a WAF:
The Lessee (the Principal) will be required to have the following insurances relating to the Lease Premises:
• Public risk insurance - $20,000,000.00 per claim
• Lessee's property and fittings at Premises
• Worker's compensation insurance
• Any other insurance required by the Lessor (acting reasonably)
There is no requirement under the lease for the Lessor to have any particular insurances.
How will damage to land be assessed and repaired?
The condition of the land and any improvements on the land will be assessed and documented at the commencement of the lease. Damage to the land during the course of the lease term and on expiry of the term will be assessed with reference to the condition at commencement of the lease (providing for fair wear and tear as outlined in clause 7 of the lease) and will be managed in accordance with the terms of the lease (notably clauses 7 - Maintenance and Repair of Premises, 8 - Lessee’s Works, 10 – Safety, 12 – Damage or Destruction of Premises, 18 – End of Lease).
