Hi There,

MIB requests a response tenth following queries pertaining to the Gunnedag Shire Depot Fuel Handling Upgrade Project

1. Provide an image (or marked up drawing) of the existing electrical switch board from where the electrical supply for the fuel tanks are to be drawn from. Mark the Electrical and Comms run on an appropriate plan from the elecrtrical supply board to the fuel tanks.

2. Is the electrical mains line to be installed above or below ground?

3. What is the depth (invert) of the of the existing stormwater pit on O'Neill Rd that the oil water separator is to discharge to?

4. Provide construction details of the 2 pits before & after the oily water separator tank. Pit size, grate/lid type & class, etc

5. Provide construction details of the 4 pits in the vehicle refuelling pavement.. Pit size, grate/lid type & class, etc

6. Confirm if it is permissible to install the vent from the oil water separator (OWS) installed at the back of oil water separator tank and in-between the bollards and mounted on uni-strut supports. Confirm f this is the ideal location.

7. Provide any DA conditions for view

8. Confirm the stormwater branch lines are 150mm each, main line to oil water separator and also to O'Neill road should be 300mm diameter.

9. The oil water separator has an alarm built in with an alarm panel to be install elswhere. Please provide location for the alarm panel to be installed.

GSC Stormwater Design currently under development. Stormwater Management Plan will design pipe and pit works as per Addendum 008 - TRC Standard Drawings.

As per Annexure H – Petro Industrial Tank Supply Specification, Petro Industrial provides a Flammable Zoning Audit, providing detail on extinguisher requirements.

Pavement (DESA 2x10^6) = Minimum 250mm pavement made up of 150mm base CBR80 with 100mm sub-base CBR30 and 13% existing CBR down to 800mm below surface.

Question:
Q1 — Contaminated soil volume (Annexure F, Waste Classification Report)

The Waste Classification Report records the "Estimated Volume of Contaminated Soil Requiring Offsite Disposal" as "Unknown," and notes that any extents or quantities stated are estimates only based on discrete boreholes. Tenderers therefore have no quantity against which to price excavation, handling and offsite disposal under Stage 2.

Can Council please either (a) provide an estimated volume or tonnage of material anticipated to require offsite disposal, or (b) confirm that this element will be dealt with as a Provisional Sum or a Schedule of Rates item so that all tenderers price on a common basis? If neither, please confirm tenderers may qualify their lump sum with a stated allowance and rate for material in excess of that allowance.

Q2 — Soil not permitted to leave the Lot vs. offsite disposal

Annexure G states that under no circumstance is any soil removed during UPSS demolition to leave Lot 1 DP 1315227. Annexure F classifies excavated soil as General Solid Waste (Non-Putrescible) suitable for disposal to a licensed landfill, and the Principal's Project Requirements clause 4.4 requires contaminated material to be removed from site and disposed of at an appropriate licensed facility.

Please clarify which requirement governs. Specifically: is all excavated material to remain on site (and if so, where is it to be stockpiled or reinstated, and what volume of imported clean fill should tenderers allow), or is offsite disposal of classified material permitted, and under what conditions?

Q3 — LNAPL, EPA notification and any Remediation Action Plan

Annexure E records greater than 1 m of LNAPL (weathered diesel) in monitoring well MW1 and recommends notification to the NSW EPA under the Contaminated Land Management Act 1997, a Detailed Site Investigation, additional monitoring wells, and a groundwater sampling programme.

Please confirm:

Whether Council has lodged, or will lodge, the EPA notification, and whether that notification is a condition precedent to Stage 2 works commencing.

Whether a Detailed Site Investigation and/or Remediation Action Plan will be commissioned by Council, and whether the outcome may alter the Stage 2 scope after contract award.

Whether a NSW accredited Site Auditor is required for the project, and if so who engages and pays for them.

Whether recovery, storage and licensed disposal of free product (LNAPL) and any contaminated groundwater is within the tendered scope. It is not referenced in Annexure G and is not covered by the Annexure F soil classification.

Q4 — Reclassification risk on validation sampling

Annexure F classifies only the material sampled at boreholes BH01–BH06. Annexure E requires validation sampling after tank removal. Material beneath and immediately around the tanks has not been characterised.

Please confirm the mechanism if post-excavation validation sampling returns a classification higher than General Solid Waste (Non-Putrescible), for example Restricted Solid Waste. Will this be treated as a latent condition or variation under AS 4000, or is the risk to be carried by the Contractor?

Q5 — Date for Practical Completion (AS 4000 Annexure Part A, Item 7)

Item 7 of Annexure Part A shows the Date for Practical Completion and the Period of Time for Practical Completion both as "TBC," while Item 24 sets liquidated damages at $1,500 per day.

Please confirm whether Council will nominate a Date or Period for Practical Completion prior to award, or whether the period offered in the Tenderer's construction programme (Returnable Schedules / PPR clause 2.8) will be adopted as the contractual Date for Practical Completion.

Q6 — Separable portions for Stage 1 and Stage 2

Stage 1 must be complete, commissioned and operational before Stage 2 commences (PPR clause 4.1), and Schedule 6 prices the two stages separately. The Separable Portions section of Annexure Part A has not been completed.

Please confirm whether the two stages are to be treated as Separable Portions with their own dates for Practical Completion, security and liquidated damages, or as a single Date for Practical Completion covering both stages.

Q7 — Tank supply lead time and possession of site

Item 22 requires possession of site within 40 days of acceptance of tender. The nominated tank supplier's manufacture and delivery lead time is likely to exceed that period.

Please confirm whether tenderers should programme mobilisation to site around the tank delivery lead time, and whether any period between possession and physical commencement will be treated as a qualifying cause of delay.

Q8 — Alliance Automation control system scope

General Conditions of Tender clause 11 nominates Alliance Automation for the control system works and requires tenderers to obtain their specification and include their schedule and pricing in the Returnable Schedules.

Please confirm:

The correct contact at Alliance Automation for this project.

Whether Alliance Automation's price is to be included within Schedule 6 Item 101 (Stage 1) or shown as a separate added line.

Whether the control system scope is additive to, or overlaps with, the iPETRO PRO Fluids Management System and automatic tank gauging in Annexure H.

Q9 — Status of the drawing set (Annexure A and Annexure B)

The drawings are Rev C, marked "NOT FOR CONSTRUCTION" and issued for Development Application. Annexure B notes that final products and volumes are "to be confirmed prior to construction," that hazardous zone extents are "nominated indicatively" and "to be confirmed during construction documentation," and that the clip-on canopy size is "to be confirmed by manufacturer."

Please confirm whether a construction-issue (IFC) drawing set will be provided before tender close or after award, and whether tenderers are to price on the Rev C DA set as issued. If IFC drawings will issue after award, please confirm how any resulting change will be valued.

Q10 — Hazardous area classification responsibility

Annexure B note on sheet F001 indicates a hazardous area assessment is not required, while the same set classifies the site as Class A / Equipment Level 1 under AS 4897 and includes a hazardous zones plan, and Annexure H identifies a Hazardous Area Dossier and zoning drawings as legal requirements under AS 3000 and AS/NZS 60079.

Please confirm that preparation of the hazardous area zoning drawings and the Hazardous Area Dossier, including independent sign-off by a qualified inspector, is within the Contractor's scope and is to be included in Schedule 6 Item 101.

Q11 — Development consent and approvals

Annexure B is a Development Application drawing set and Annexure H excludes Council approvals from the tank supplier's offer.

Please confirm whether development consent for the new facility has been granted, and if so provide the consent and its conditions. Please also confirm which approvals (development consent, construction certificate, SafeWork NSW notification of Schedule 11 hazardous chemicals, EPA notifications, electrical and NMI certification) are the Contractor's responsibility and which are Council's.

Q12 — Power supply

Addendum 004 advises the closest 3-phase power to the new facility is approximately 50 m away.

Please confirm whether the Contractor is to design and install the full electrical supply from that point, including any switchboard, metering, upgrade or Essential Energy involvement, and confirm the available capacity at that point is adequate for the facility.

Q13 — Existing UPSS defects and decommissioning condition

Annexure E records a leaking gasket on Pump #1 (Tank #1, diesel) identified during integrity testing, which remains unrepaired.

Please confirm whether Council will rectify this prior to handover of the UPSS for decommissioning, or whether it is to be managed by the Contractor as part of the Stage 2 works. Please also confirm the residual fuel volume expected to remain in each tank at handover, given PPR clause 4.1 states tanks will be drained through normal operations.

Q14 — Fire hydrant trench

Annexure E identifies an underground fire hydrant trench as a possible preferential contamination migration pathway and recommends it be investigated.

Please confirm whether investigation, excavation or remediation of that trench forms part of the tendered scope.

Q15 — GST treatment

General Conditions of Tender clause 4.3(c) states tenders are to be inclusive of GST unless otherwise stated, while Schedule 6 states all pricing is to be exclusive of GST.

Please confirm that Schedule 6 is to be completed exclusive of GST.

Q16 — Discrepancies in the tender documents

For completeness, tenderers note the following and request confirmation of the correct position:

Annexure D states there are no existing groundwater monitoring wells on site, while Annexure E investigates existing well MW1 and Addendum 005 provides coordinates for seven wells (MW1, MW3–MW8).

Annexure D states a net increase in stored volume of 28.5 kL; the proposed 65.5 kL less the existing 45 kL gives 20.5 kL.

Annexure E carries a cover date of July 2025 with fieldwork dated 16 June 2026 and integrity testing dated 7 July 2026.

Schedule 6 Item 102 refers to the "Principal's Project Requirements — Annex I"; tenderers assume this means Annexure G — UPSS Removal Scope of Works.

Q17 — Question cut-off

The General Conditions of Tender set a question cut-off of 12:00pm 18 September 2026. Addendum 006 extended the closing date to 11:00am AEDT 7 October 2026 to allow Council to respond to requests for information made via the forum.

Please confirm the forum remains open for questions and advise the revised cut-off date for further queries.

Q1 — Contaminated soil volume (Annexure F, Waste Classification Report)

As per Annexure G – UPSS SOW, no excavated soil is to leave the site as there is no requirement to remove and dispose of contaminated soil. Any excess soil excavated during UPSS removal is to be backfilled into void left by removed tanks.

Q2 — Soil not permitted to leave the Lot vs. offsite disposal

Clause 4.4 in Principle’s Project Requirements refers to general waste materials that are won during construction which are previously unknown. Refer to Annexures listed 4.1 of Principle’s Project Requirements for known construction specifics. As per Annexure G – UPSS SOW, no contaminated soil is to be removed from site.

Q3 — LNAPL, EPA notification and any Remediation Action Plan

Council has lodged all required documentation with the EPA. Tenderers are not required to conduct dealings with EPA.

A Detailed Site Investigation (DSI) has been carried out with final report currently being completed. The outcome of the DSI will not affect award of Stage 2 in any way.

Any and all State/Federal Auditing requirements will be conducted by Council under advice from the EPA. Tenderers are not required to engage government regulatory bodies for the works.

Tenderers are not required to include any recovery, storage or disposal of free product under the WUC.

Q4 — Reclassification risk on validation sampling

If the Detailed Site Investigation recommendations require further testing post tank removal, and if these sample tests deem material classification requiring offsite disposal, then this will be treated as a latent condition under the WUC.

Q5 — Date for Practical Completion (AS 4000 Annexure Part A, Item 7)

The period offered by the Tenderer’s construction programme will be adopted as the contractual Date for Practical Completion.

Q6 — Separable portions for Stage 1 and Stage 2

Both Stages are to be treated as a single body of work with a single Date for Practical Completion and not as Separable Portions. Tender Documents have advertised them as Stage 1 and Stage 2 to advertise Council’s requirement to sequence them as such in order to minimise operational disruption during the works.

Q7 — Tank supply lead time and possession of site

40 days as per Item 22 indicates the minimum time available for Council to provide the Contractor possession of the site after awarding of the Tender, which allows Council time to ensure Operations are reorganised and the site is clear for WUC to begin. Tenderers are free to nominate possession timeframe outside of 40 days as per their construction programme. Any period between possession and physical commencement will not be treated as qualifying cause of delay.

Q8 — Alliance Automation control system scope

Please disregard, this should have been removed when reviewing the documents and does not apply to this tender.

Q9 — Status of the drawing set (Annexure A and Annexure B)

Tenderers are to price on the Rev C DA set. Construction issue will be provided after award and if any change is required, values will be treated as a variation to the WUC.

Q10 — Hazardous area classification responsibility

As per Annexure H – Petro Industrial Tank Supply Specification, Petro Industrial provides Hazardous Area Zoning and Dossier documentation as part of their supply and delivery. This cost is to be included as per their provided pricing specification.

Q11 — Development consent and approvals

DA consent has been given and DA conditions provided as addendum.

All DA Construction Certificate conditions are to be conducted by Council and a Construction Certificate will be provided prior to WUC.

Safework NSW notification of Schedule 11 is the responsibility of the Contractor as per WUC.

EPA Notifications are the responsibility of Council.

Any new electrical connection certifications are the responsibility of the Contractor as per the WUC.

Q12 — Power supply

Any and all electrical supply requirements for the new tank connection are the responsibility of the contractor as per the WUC.

Q13 — Existing UPSS defects and decommissioning condition

Pump 1 leaking gasket has been rectified. UPSS tanks will be drained as complete as bowser pumps will allow prior to removal works. Minimal residual liquid is expected to be remaining in the UPSS tanks prior to removal.

Q14 — Fire hydrant trench

It does not form any part of this tender.

Q15 — GST treatment

Pricing is to be exclusive of GST as per schedule 6.

Q16 — Discrepancies in the tender documents

Eight (8) Monitoring Wells have since been installed as per addendum.

Q17 — Question cut-off

As the tender closing date changed the question forum closing date changed. The tender question forum will closed at 10:00am on Wednesday, 30 September 2026.
