Bayside Council invites suitably experienced and qualified Contractors to submit a tender for the demolition of the existing Le Beach Hut and Dolls Point Café building and the construction of a new restaurant, kiosk and public amenities building at 179 Russell Avenue, Dolls Point NSW. The Le Beach Hut was constructed in the 1950s and is located on Lot 67-70 on Deposited Plan 2237 within the Peter Depena Reserve.

Bayside Council anticipates awarding the Contract in March 2027, subject to completion of the procurement process. Site establishment is expected to commence upon execution of the contract. Tenderers must all hold their submitted prices valid until contract award.

A mandatory site inspection will be held on Tuesday, 29 September 2026 at 2:00 pm. The meeting point is the loading bay adjacent to Coffee in the Park Café.

Attendance will be recorded and only Contractors who attend the site inspection will be eligible to submit a conforming tender.

Tenderers are strongly encouraged to review all tender documents prior to attending the inspection. While queries may be submitted following the inspection via VendorPanel, this will be the only opportunity to inspect and photograph the restaurant and cafe's internal areas and to seek clarification of project requirements in person.

Tenderers should attend fully prepared with any questions. Any subcontractors, consultants, or other parties whose advice will be relied upon in preparing the tender may also attend.
Background information / Compatibility requirements
Details
The Le Beach Hut is a single level building comprising a restaurant and a separate kiosk. The building’s total floor area is approximately 830m2. The restaurant is located on the eastern side of the building and has a floor area of approximately 650m2. Primary access to the restaurant is via Carruthers Drive and secondary access is available from Peter Depena Reserve. The kiosk is located on the western side of the building and has a floor area of approximately 180m2.

The building is constructed on concrete foundations which are in fair condition. The brick perimeter walls have been partially rendered and the roof is timber construction with a metal cover. The condition of the load bearing walls is poor to fair and the roof structure, roof cover and general external finishes are in poor condition with significant deterioration.

The perimeter metal frame windows, fittings and fitments have severely corroded and moving parts are limited in terms of functionality. The timber frame windows are also in very poor condition with significant deterioration. A roof mounted antenna has collapsed and is not functional.

2. Approvals: Current status of the section 4.55 modification, CC1/CC2, lot consolidation and any outstanding Sydney Water or authority approvals; identify the party responsible for each condition and fee.

3. Documents: Issue the promised BOQ and confirm when the structural, hydraulic, electrical, mechanical, civil, food-service and roof safety construction drawing sets will be available. They appear in the tender index but were not among the files supplied to me; the combined architectural set does contain its architectural sheets.

4. Ground and hazardous materials: Confirm the payment mechanism for concealed asbestos or contaminated material outside the surveyed areas, additional waste classification, groundwater control and unknown services, given item 37’s risk allocation.

5. Document control: Appendix F’s repeated page header says “DA-2024/128 — Sir Joseph Banks Park”, and one line within it retains that DA number, while its project field and the actual consent identify DA-2024/374 Depena Café. Request a corrected CC matrix and confirmation that every assigned condition has been checked against the actual consent.

6. Fees: Contract Information item 14A says the contractor does not pay the long service levy, while the CC matrix labels its $14,051 payment as a contractor requirement. Ask Council to reconcile this and the housing contribution and certification fees before pricing.

1. Ausgrid: What has been accepted, designed and paid for; who funds ASP/3, ASP/1, Ausgrid fees and the existing substation upgrade; and what energisation date should tenderers program?

Council has engaged Sam Crawford Architects, who in turn has engaged JN Electrical Consultant to undertake the ASP3 design for the Ausgrid electricity supply upgrade. The ASP3 scope includes:

1. 1 x 400A LV Direct Distributor Design as per the Ausgrid offer.

2. Low voltage underground design activities including field measurements and BYDA searches.

3. Preparation of Concept plan and notification to council and as required under the T&I SEPP, Part 5 of the EPA&A Act (1979) and Electricity Supply Act s45 – providing 40-day notification.

4. Preparation of Standard Ausgrid Environmental Impact Assessment (SER).

5. Preparation of all standard Ausgrid documentation required for design submission and certification to RFT stage.

6. Attendance of 1 off pre-construction meeting with Ausgrid Contract Inspector and selected L1 ASP contractor allowed for in Part A scope. Additional meetings charged at hourly rates as part of RFC stage – only where required.

7. Alterations to designs at RFC stage requiring recertification is excluded and charged at hourly rates or for an agreed fee depending upon scope.

The ASP3 design is currently being finalised and has not yet received Ausgrid approval. Will provide a preliminary ASP3 drawing named ‘ASP3 PRELIM Design Drawings - Depena Cafe’ in Addendum 02. Note the design is preliminary.

The successful contractor will be responsible for engaging an ASP1 contractor to undertake the electrical works in accordance with the approved ASP3 design, including coordination with Ausgrid for construction, commissioning and energisation.

Council has funded the ASP3 design consultant engagement. Tenderers should allow for all costs associated with the ASP1 works, Ausgrid coordination, approvals, inspections, fees and charges required to complete the electrical supply upgrade.

As the ASP3 design has not yet been approved by Ausgrid, an energisation date cannot be confirmed at this stage. Tenderers should liaise with their proposed ASP1 contractor and Ausgrid when developing their construction programme and allow sufficient time for Ausgrid approvals, construction, commissioning and energisation activities.

Below is the status as of 28/09/2026:

• S4.55(1A) to be submitted to Council early October 2026

• CC1 to be submitted by Contractor once engaged

• CC2 to be managed by future tenant

• Lot Consolidation managed by Council. Should be finalised by February 2027

• Council has engaged Opal Water Management (Water Services Coordinator) for S73, sewer minor works design and Building Plan Approval. Contractor’s plumber to liaise with SW for tap-in. Contractor to liaise directly with Opal Water Management.

• All authority fees to be paid by Contractor. Please indicate a cost for all Authority Fees in Tender Schedule - Schedule of Lump Sums

Contractors are to satisfy themselves as to existing site conditions and include for reasonable investigation of the site, including obtaining Before You Dig Australia records, service locating and geotechnical investigations. Existing information available to Council has been provided as part of the RFT documentation.

Groundwater management and dewatering measures required to satisfy the Development Consent, including Condition 57, are to be included within the tendered price.

Council has engaged geotechnical consultant, Aretas Group, who has installed a groundwater monitoring well. Groundwater monitoring, laboratory testing and reporting are currently underway, with results anticipated in mid-October 2026. Any information available prior to RFT closing will be issued to tenderers by addendum.

In relation to concealed asbestos, contamination outside surveyed areas, unexpected waste classifications, groundwater conditions and unidentified services, any entitlement to additional payment will be assessed in accordance with the relevant provisions of the Contract and the risk allocation set out in the RFT documentation. Tenderers should identify any assumptions, exclusions or departures in their submissions.

5. Document control: Appendix F’s repeated page header says “DA-2024/128 — Sir Joseph Banks Park”, and one line within it retains that DA number, while its project field and the actual consent identify DA-2024/374 Depena Café. Could you please confirm whether PPE is required for the site visit?

PPE is not mandatory for the site visit as this is not an active construction site. However, attendees will be accessing areas that may be unmaintained and dirty. Appropriate enclosed footwear is recommended.
