It is noted in Part B, in Section 2 Terms and Conditions that "The applicable terms and conditions for the supply of the Goods and/or Services to a Customer under this Contract are the Comprehensive Contract Conditions Version 3.4, current as at January 2026" - please can you either provide a copy of these terms, or confirm that you actually intend to contract using Version 3.5, current as at July 2026?

TMR confirms that the reference to the "Comprehensive Contract Conditions Version 3.4, current as at January 2026" in Part B, Section 2 was included in error. The applicable contract conditions for this procurement are the General Contract Conditions July 2026, which were released as part of the Invitation to Offer documentation. This aligns with the contract conditions intended to apply to the Contract. The reference in Part B, Section 2 should therefore be read as referring to the General Contract Conditions July 2026, rather than the Comprehensive Contract Conditions Version 3.4.

TMR confirms that the procurement reference number shown on the Part A Invitation to Offer front cover as TMR-ETCS-0074 is incorrect. The correct procurement reference number is TMR-ETCS-0077 and this should be used when preparing and submitting your response.
TMR also confirms that the closing date for this Invitation to Offer is Thursday, 24 September 2026. We are unable to verify the reference to Friday, 25 September 2026 and note that the activity has been published in VendorPanel with a closing date of 24 September 2026.
For the avoidance of doubt, respondents should use TMR-ETCS-0077 as the procurement reference number and 24 September 2026 as the closing date when preparing their submissions.

1. Mandatory organisational experience
For the mandatory requirement concerning experience deploying onboard ETCS or onboard CBTC, can this experience be demonstrated collectively through the Offeror, its named subcontractors and proposed personnel, or must the Offeror’s contracting legal entity itself hold this experience?
2.Alternative candidates for one role
Part A permits up to two candidates to jointly perform a role as a job-share. Can an Offeror instead nominate two alternative candidates for the same role, with each candidate evaluated separately and only one appointed? If permitted, should they be included in one offer or submitted as separate alternative offers?
3. Multiple specialists under the ETCS Rollingstock SME role
Can Resource 5 be delivered by multiple individuals who collectively cover RF engineering, ETCS Baseline 4 and ATO Baseline 4? If so, can each individual satisfy the requirements only for their nominated specialist field, with separate CVs and hourly rates provided for each SME?
4. RPEQ status at tender close
For the Project Engineer and Onboard Engineer roles, must each candidate hold current electrical RPEQ registration at the offer closing date, or would TMR accept a suitably qualified candidate who obtains the required RPEQ registration before commencing the Services?
5.Role-by-role evaluation and award
Where an Offeror submits for fewer than the six roles, will each proposed role be evaluated and capable of award independently? Please also confirm that submitting a partial team will not render an otherwise conforming offer less competitive for the roles proposed.
6.Mobilisation and availability
Is TMR seeking each resource at their nominated FTE allocation immediately from the anticipated October 2026 commencement, or will staged mobilisation and reasonable candidate notice periods be considered?
7. Workplace attendance
Please confirm the expected proportion of each role’s time to be performed at 140 Creek Street, at depots/test facilities and remotely, and whether hybrid working arrangements may be proposed.
