The Department of Transport and Main Roads (TMR) intends to release in late-October an Invitation to Offer (ITO) to the market for an Independent Safety Assessor (ISA) to provide independent safety assessment services for The Wave (Rail) and the Sector 1 North European Train Control Signalling Level 2 (S1N ETCS) (including Digital Radio Systems (DRS)) (ISA Package).

This Forward Procurement Notice provides preliminary information to assist prospective participants with preparing a response to the ITO for the ISA Package, including the

requirements that prospective participants must satisfy as a pre-requisite to receiving the ITO from TMR.

This Forward Procurement Notice in no way commits TMR to issue the ITO or to proceed with procurement for the ISA Package. If the ITO is released to the prospective participant, the information contained within the ITO supersedes all information provided in this Forward Procurement Notice.

Question:
We note the ISA Forward Procurement Notice restrictions for the ISA package, e.g. if the organisation is part of a consortium appointed as an ECI Contractor or AD Proponent, or if the organisation is advising the State in relation to The Wave Stage 1, The Wave Stage 2, or S1N ETCS (including DRS).

However, the requirement for independence does not mention any restriction criteria for the ISA package in relation to the Independent Certifier (IC) package (VP Reference: P480510). The IC Forward Procurement Notice similarly does not nominate any restriction criteria for the ISA package.

In lieu of any stated restriction criteria for either package, is there any barrier to an organisation/individual or consortium being involved/appointed on both the ISA and IC packages?

Question:
Are there any restrictions on an ISA SME organisation supporting multiple consortiums applying for the ISA package? E.g. an organisation/sole trader who does not meet the criteria of being the lead tender applying for & leading the ISA activities, but has relevant specialist domain ISA experience as a subcontractor to Lead ISA organisations. As a small business providing niche ISA SME technical services, we don't want to "back the wrong horse" (so to speak) and be restricted to only supporting one applicant, so would prefer to offer our services as an subcontractor to a couple of the ISA applicants bidding for this work.
