Hinchinbrook Shire Council (HSC) is seeking to engage a suitably qualified project partner to deliver end to end consultancy services associated with the project management, planning, preliminary design and Principal’s project requirements, and tender documentation for trunk wastewater infrastructure to support priority residential growth areas in the Hinchinbrook Local Government Area.

This Request for Tender (RFT) is issued as part of Council’s implementation of the Hinchinbrook Local Housing Action Plan (2021), which identifies the urgent need to increase the supply of flood-resilient, serviceable land for residential development. The objective is to unlock approximately 180 new residential lots across three greenfield sites, which remain undeveloped due to the absence of enabling trunk infrastructure and prohibitive servicing costs in a low yield regional market.

Good afternoon,

We have undertaken a thorough review of the scope of works outlined by Council and seek clarification regarding the potential classification of our submission as non-conforming.

Our team possesses the requisite expertise across engineering, planning, and consultancy disciplines to successfully deliver the project in collaboration with Council. However, we note that the scope includes the provision of legal reviews, advice, and inputs throughout the project lifecycle. As legal services are expressly excluded under our insurance coverage, we are unable to provide these services either directly or via subcontracting arrangements.

In light of this, we respectfully enquire whether Council would consider engaging legal services independently. We remain enthusiastic about the opportunity to contribute to this important initiative and wish to confirm whether the exclusion of legal services from our proposal would affect its compliance status i.e. being deemed non-conforming.

Good morning

Thank you for your question. The Principal Consultant would need to engage with their own sub consultant, effectively acting as part of their project team. There is no requirement for the Principal Consultant to have their own in-house legal expertise.

The prospective tenderer would need to detail the key personnel within that nominated legal firm, with relevant experience and qualifications necessary for assessment.

In terms of insurance, the Principal Consultant should be responsible for undertaking due diligence to ensure any legal service providers they engage, hold appropriate professional indemnity cover, thereby protecting the Principal Consultant in meeting their contractual obligations with Council.
