In reference to Schedule C – Rise and Fall calculations, and in light of the extended period between the tender closing date and the service commencement date, we respectfully request that the base date for the rise and fall adjustment be amended to the index quarter published prior to the tender closing date. Additionally, we propose that the first adjustment be applied on the service commencement date.
Given the volatility in the global fuel market due to ongoing uncertainties in the Middle East, having an extended base date creates significant uncertainty. This is likely to lead to higher pricing from tenderers, as they would need to factor in additional risk and potential cost fluctuations.
These amendments would allow tenderers to base their pricing on known costs, ensuring alignment with current market conditions, while adjusting in line with actual costs as they materialize.

Council agrees to the proposed amendments and has provided an updated version of BSC 2526 - T35 Part C - Conditions of Contract, labelled v2, incorporating the agreed changes. Please use this version in place of the previously issued version.

In relation to 10.4 Contamination Audit and the Contamination Level of Part D (Specification), as the methodology is to be agreed upon during the contract, an accurate cost cannot be determined by tenderers at this stage.
Could Council please confirm that the cost of the audits will be covered by the financial contribution outlined in Item 14, Schedule A (PART C)? Alternatively, is Council able to specify an allowance to be factored into the service rates?

Council has not planned to fund contamination audits from contributions and is of the opinion Tenderers would be best placed in providing and costing these exercises. Therefore, Council expects the tendered service prices are inclusive of costs for contamination audits as specified. Methodology for undertaking these audits and costings should also be provided as part of the Demonstrated Understanding information requirements of the tender submissions.”

Currently, 20 properties are being charged for cleansing (excl. Hebel SS, Store & Hotel) and there are also 21 vacant properties that fall within the service area but do not attract any cleansing charges.

There are no major future developments known to Council at present. Current or impending developments include a 9 lot subdivision along Bowen & Alfred Streets, St George (the rest of the subdivision is still quite some time off being compliant to sell lots), and another 4-5 lot subdivision potentially available in the near future. Additionally, the State Government Development will shortly release a 14 small lot subdivision in St George.

Could Council please provide a list of all Service-Entitled Premises requiring Wheel-out and Wheel-back Collection Services where a kerbside service is not practical (excluding Assisted Services), and as such will not be considered a Variation under Clause 18 of the Conditions of Contract?

There are no listed “Assisted Services” currently however there may be four soon identified for the Scott Street development. It is anticipated that the Department of Housing will locate four elderly residents into this complex.

As it is not possible for Contractors to anticipate future legislative changes that may arise between now and contract execution, could clause 1.3 (Definitions – Change in Law) be amended to refer to any change in law that occurs after the Tender Closing Date (not the Contract Commencement Date)?

Schedule B – Pricing of the Response Form states recyclables collection must include all costs for the collection, bulking up, transport, processing of recyclables (including transportation to the Nominated Facility comprising the Materials Recovery Facility) and disposal of residual waste from the processing requirement, however clause 13.8 of the Specification states Council will retain ownership of the recyclables and will pay all disposal and processing charges and the sorting a separation of recyclables is not part of this contract. Can Council confirm its position on what the Contractor must do with the processing of recyclables?

Schedule B – Pricing Response Form is correct. Clause 13.8 of the Specification was intended to address the Contractor’s obligations for all three waste streams of Waste, Recyclables and Garden Organics. This clause has now been amended to reflect ownership and obligations of each of these streams.
