Invitation To Offer for the Provision of Personnel Protective Equipment

The Department of Health (ABN 66 329 169 412) invites offers from Tenderers for the provision of personnel protective equipment via a Standing Offer Arrangement (SOA). The SOA has 7 Separable Portions as detailed below. Each Separable Portion will be awarded to a single supplier for provision of that service. Tenderers are invited to respond to one (1) or more of the Separable Portions. The SOA will be between Queensland Health and awarded Suppliers. The service will be required to be delivered to Queensland Health Distribution Centres and Regional Warehouses only (individual Hospital and Health Services will not be customers under the SOA).

This ITO has four (4) parts

Part A - Invitation to Offer (Tenderer to read and retain)

Part B - Standing Offer Arrangement (SOA) Details (Tenderer to read and retain) - Provides details of the draft SOA and Contract conditions, price and payment terms, KPI’s. Importantly Schedule 1 of this document provides the requirements for each Separable Portion of the SOA.

Part C - ITO Response Schedule (TENDERER TO COMPLETE AND RETURN) - Tenderer is to complete Worksheet two (2), three (3) and four (4) of Part C and submit the Part C - Response Schedule and any referenced attachments by the Closing date and time

The requirements for Separable Portion 4 - Procedural Level 2 Gowns are provided in Part A - Invitation to Offer, Schedule 1, Section 5 (page 17).

Tenderers must ensure the Gown offered meets these requirements. Colour and Cuff type are not specified. Part D - Price Schedule, Worksheet - Price 4 - Level 2 Gowns, allows tenderers to detail the cuff type and colour for the Gown they are responding with.

In determining the Gown offered in their response Tenderers should consider the evaluation process in full, refer to Part A - Invitation to Offer, Section 1.11.

In Section 3 of the tender document, you are requesting Cytotoxic Gloves to be tendered, can you please confirm if you are looking for:

a) Non-Sterile Cytotoxic rated gloves only?

b) Sterile Gloves to be included?

c) Gloves only used in the clinical setting?

d) Gloves used in the Compounding/Pharmacy area of the Hospital?

e) Gloves that will show indication of top glove breach to protect the sterility of the compound and protect the end user/clinician?

a) All products regardless of what Separable Portion of the contract tenderers are responding must meet the General Requirement (Part B, Schedule 1, Section 1) and the requirements applicable to that Separable Portion (Part B, Schedule 1, Section 2-8).

Part B, Schedule 1, Section 3 - Separable Portion 2 - Cytotoxic Gloves, includes a requirement for the product to be Non-Sterile.

b, c, d, e) Refer above. Sterile Gloves do not meet the requirement for this Separable Portion. Queensland Health is looking to procure a Cytotoxic glove that meets the requirements as detailed in Part B, Schedule 1, Section 3.

Any Glove that does not meet the requirements would be considered non-conforming.

Please ensure you review the evaluation process detailed in Part A, Section 1.11 for details on how tender response will be evaluated.

1. Part A, Section 1.11.2 includes the Mandatory Criteria for all tender submission. This includes tenderers providing evidence of all products being TGA/ATGR approved. If a supplier cannot provide this evidence the product/response would be considered non-conforming.

2. Order quantity is not specified. Part A - Attachment 2 - Queensland Health Supplier Guide details all requirements regarding ordering and delivery to the Distribution Centers and Regional Warehouses.

Delivery location and product demand will influence order quantities. Forecast volume usage in included in Part A, Section 1.7.

Queensland Health endeavours to be efficient in how it orders products where possible.

The requirements listed in Part B, Schedule 1, Section 1 - 8 detail what products and services that must be delivered under each Separable Portion of the arrangement. Every single one of these requirements must be met or the response will be non-conforming as the tender is not able to deliver the product or services required by Queensland Health.

Detail that has not been included in Part B, Schedule 1, Section 1 - 8 has been determined to not impact the performance of the product.

a) Part B, Schedule 1, Section 3 - Separable Portion 2 - Cytotoxic Gloves list that the gloves must be Purple. Gloves that are not purple do not meet Queensland Health needs and are therefore non-conforming.

b) Packaging has not been included in the requirements and therefore not dictated by Queenland Health. Please consider the evaluation process detailed in Part A, Section 1.11.1 when determining how product will be packed as part of your tender submission. Part D, Worksheet 3 - Aprons allows you to input your unit of measure for the product.

c) Colour has not been included in Part B, Schedule 1, Section 4 - Separable Portion 3 Non-sterile plastic aprons as it does not impact the performance of the product. Part D, Worksheet 3 - Aprons allows you to input the colour of the product.

1.) Ref to Product Portion 3 – Non-Sterile Plastic Aprons:

o The Requirement listed in Part B: Indicated your required size are Between 1100mm – 1400mm in length and 600mm to 900mm in width; But meanwhile, it has also asked Available in a universal size?

o Would you please advise whether will QLD Health prefer to have ranges of sizes or a universal size which can fit for all?

2.) The ITO has asked for AAMI PB 70 Level 2 isolation Gown; But it has not asked for AAMI PB70 Level 3 Gowns, we think you may need to consider to be included it based on the following reasons:

• Based on our experience in Australia, the usage of AAMI PB70 Level 3 Isolation Gowns should be much higher than AAMI PB 70 Level 2 isolation Gown. For instance, during the COVID period, most required isolation gowns are AAMI PB70 Level 3 Gowns and Level 2 Gowns are Not acceptable.

• During the COVID, some AAMI PB70 Gowns can only be claimed as AAMI PB70 Level 2 due to the fact that some of its seams can not be fully qualified as AAMI BP70 Level 3; but more or less their function are similar to AAMI PB70 Level 3. Therefore, we would suggest that you can list the Products that your current using and you think it can meet your current requirements, We can simply match it with our corresponding products!

• We understand that in most cases the Portion 5 – Backless Long Sleeve Splash Resistant Gowns can be classified as the special Class of AAMI PB 70 Level 3 Gown – Open back Gown (Therefore, it should be called as Open Back; Not Backless, as in many cases, it has still got some parts of back, jus open parts of them) ; But there are many other styles are available to meet different need and requirements. In fact, our company is asking by QLD Metro North Health to supply AAMI PB70 Level 3 Gowns now.

• Therefore, would you please advise whether can we also included our ranges of offer for AAMI PB70 Level 3 Gowns in the ITO, If so, would you please advise whether can we list these gown in Separable Portion 4, as in principal, any AAMI PB70 Level 3 Gowns should be able to fully comply to all requirements of AAMI PB70 Level 2 standard requirement.

3.) The ITO has not specially asked for Chemo Procedure Gowns for the Handling of Chemotherapy Medication.

• In terms of Fluid Barrier Protection Performance, most of Chemo Procedure Gowns for the Handling of Chemotherapy Medication can also be classified as AAMI PB70 Level 3 with additional requirements for tested against the list of chemotherapy drugs per ASTM F739-20 and no breakthrough was observed during test duration of 480 minutes based on average standardized breakthrough time.

• would you please advise whether will QLD Health may also need to be offered Chemo Procedure Gowns for the Handling of Chemotherapy Medication in Separable Portion 4?

4.) This ITO has asked for both Level 2 & 3 face marks, but Not specific asked for other facial protection products, such as Disposable Face Shield and Eye Shied, would you please advise whether will QLD Health also need to require for these facial protection products too? As You may know that these PPE products have been widely required by normal situation (such as CSSD) and also COVID pandemic period? Would you please advise whether can we also list these Facial Protection Products in the ITO?

5.) This ITO has NOT asked for any disposable shoes cover and boots cover etc, Would you please advise whether will also QLD Health also require for these disposable shoes cover and boots cover products? If not what will it be covered by any other QLD Contracts? Or will it not be covered by any QLD Contracts?

1) The Non-Sterile Plastic Apron is to be available in a Universal Size. That sizing needs to provide an area of coverage between 1100mm-1400mm in length and 600-900 in width.

2) Consideration has been given to AAMI PB70 Level 3. Queensland Health requires tenderers to be compliant with the specification in Part B, Schedule 1 Section 1 - 8 depending on the Separable Portion they are responding to. For Separable Portion 4 (Part B, Schedule 1, Section 5) that includes a product that is ANSI/AMI PB70:2022 compliant.

3) Queensland Health requires only the services detailed in Part B, Schedule 1, Sections 1-8 to be provided by a Supplier.

However, the issued contract includes clauses on price optimisation, assignment, and novation—terms which may imply a broader end-customer base from a legal perspective.

Could you please confirm whether we are permitted to submit departures to align the scope of the contract strictly with the customer profile described in the Request Summary Report? Our pricing has been structured accordingly, and it is important that the terms reflect this defined scope.

Portion 3 – Aprons: Our unit of measure is a box of 400 aprons. Would it be acceptable to submit 3 individual aprons to each address instead of a full box?

Portion 4 – Level 2 Gowns: Our unit of box (UOB) is either 50 or 100 gowns. Can we submit 3 gowns each in universal and extra-large sizes—including a variety of knitted, elastic, and thumb loop cuffs and different colours—to each address instead of a full box?

Portion 5 – Backless Gowns: These are available in one universal size with the same cuff type and a variety of colours. Can we submit 3 gowns to each address instead of a box of 50?

Portion 6 – Level 2 Masks (Child Size): Due to limited stock, may we send 10 individual masks to each address instead of a full box of 50?

Queensland Health is procuring one (1) Gown in two (2) sizes under Separable Portion 4 - Procedural Level 2 Gowns and Separable Portion 5 - Backless Long Sleeve Splash Resistant Gowns. Samples of those sizes for the single gown you are responding with are required. Where the requirements of the Separable Portion say blue OR yellow (for colour) or knitted OR elastic cuffs or secured via overhead fitment or via a tie at the neck there is no preference by Queenland Health and it will not influence evaluation of the products. Tenderers should select their product that best meets the requirements for a Separable Portion only as part of their response.

Queensland Health is procuring one (1) mask in two (2) varieties of fitment (ear loop and tie back) under Separable Portion 6 - Level 2 Masks and Separable Portion 7 - Level 3 Masks. There is no requirement for paediatric (child) masks.

Regarding the Foreign Currency (Schedule 2– Price and Payment Terms) – could you please advise where is the Master Payment Assumption Deed located ?

This is mentioned at 2.3 "If the Customer agrees to accept Prices in a foreign currency, the Supplier must enter into a Master Payment Assumption Deed between the Supplier, the Customer and Queensland Treasury Corporation (QTC) (in the form attached in the relevant appendix to this Schedule 2, without variation by the Supplier) under which QTC will assume the payment obligations of the Customer under this Contract."

For the Separable Portion 6 - Level 2 masks, the Price D - Pricing spreadsheet allows both earloop and tie-back masks. However, we only have earloop masks available to tender. Could you please confirm if we are still permitted to proceed with submitting a tender for earloops only?

Both ear loop and tie back options need to be provided by the supplier to be able to meet the requirements of the arrangement.

Hello Jae,

During the industry briefing, it was mentioned that a separate PPE tender will not be facilitated by Medical Consumables to support purchasing for HSS sites. It was also noted that each separable portion will be awarded to a sole supplier.

Could you please clarify the Principal’s strategy behind this approach? Narrowing down to a sole supplier per separable portion could potentially increase supply risk, particularly in the event of supply chain disruptions or performance issues ?

Wouldn’t a panel supplier model offer greater flexibility and risk mitigation by providing alternative supply options, ensuring continuity of supply, and improving responsiveness to fluctuations in demand?

Queensland Health is aware of the potential supply chain risk with the sourcing strategy. The low clinical preference and availability of the PPE products being sourced along with the contractual terms for the arrangement address these risks.

I appreciate you have previously provided response to the samples quantities however can you please clarify if your reference to a box using the following example - Separable Portion 6 - Level 2 masks, if a box = 50units and a carton is 1200units ( with 24 boxes in a carton) The sample requirement is a inner box of 50 not a carton of 1200 units. Regarding the backless long sleeve splash-resistant gowns, could you please clarify whether 'splash-resistant' refers to water resistance? Additionally, could you confirm the required level of resistance in accordance with the AAMI PB70 standard?

Splash resistant is water resistant however for Backless Long Sleeve Splash Resistant Gowns there is no requirement to achieve a specific level of water resistance or compliance with a standard.

Subject: Clarification on Sample Submission and Packaging Requirements

Dear Jae,

I would like to clarify the requirements regarding sample submission.

When submitting the product samples, are we required to provide them in their final retail packaging?

Our overseas manufacturers produce plastic aprons and nitrile gloves (with cuff length =280mm) which, although not yet available in the Australian market, can be manufactured to meet the required specifications. However, as the final packaging is typically printed only when large quantities are produced, they are currently only able to provide existing packaging, which may not fully comply with Australian standards.

In this case, would it be acceptable to submit the product samples in the manufacturer’s currently available packaging, accompanied by a soft copy of our proposed final packaging design?

Yes, that would be acceptable. However, please ensure that all the mandatory criteria is met in full (e.g. TGA approved) as part of your response.

We have the following questions that I wish to get your advices:

1.) Part A – 1.14 - The Principal will enter into an SOA with a single supplier for each Separable Portion of the SOA to provide the goods and services required under each Separable Portion to the Eligible Customers.

GSI Question: Please clarify whether will it meran there will only be ONE supplier for each Separable Portion? Even in such situation among to multiitems suppliers', some items have some advantage than each other?

2.) Part C – Sample Requirements:

• Would you please advise whether have the ITO got the last date that our submitted samples Must be received?

• As you may know, if we will adopt any Express Delivery, normally, it will require to list the receipt Telephone Number. Would you please provide us such telephone number for the delivery purpose only?

There will be a single supplier awarded under each Separable Portion of the SOA.

Samples are required for evaluation from the 8th of May. All samples should have been received at the required locations before the 6th of May.

Telephone numbers are not needed. The addresses listed are complete.

In the reponse file Part C under the section Indigenous Business, the question asks 'If an indigenous business please indicate if the tenderer is certified and published online? (e.g. Supply Nation, Black Business Finder)?' we have answered No. The next question however asks 'If no, is the tenderer able to produce Statement/s of Indigeneity? We are not an indigenous business so we do not have a statement of Indigeneity, what response should be entered here?

This is a mistake. The next Question should say "If yes, is the tenderer able....". There is no need for this question to be completed by any tenderer that is not an indigenous business.

I will not amend Part C for this mistake alone as Tenderers will have started completing this paperwork. If additional amendments are required i will address this mistake.

There will be no extension to the deadline to receive samples.

Part A, Schedule 1, Section 2 clearly says available is a size greater than or equal to 220mm and 280mm. Exact cuff length is not specified.

Extra Small is a size required by Queensland Health.

Hi Jae,

Thank you for clarifying the sample request document this morning.

Please be advised that we have posted the samples yesterday to the addresses listed in the tender document already.

For Portions 1 and 2, since the gloves were packed in individual cartons, I labelled the cartons with “Portion 1 Samples” and “Portion 2 Samples” respectively. However, I didn’t label each individual glove box inside—just the outer cartons. Each portion was packed in a separate box. I hope that’s okay.

For the other portions (3–7), since multiple portions were packed into a single carton, I labelled each item with the portion number, product name, our company name, etc., so everything should be clearly identifiable.

Please kindly confirm if this is acceptable.

Part C Response Schedules, Worksheet 3 - Mandatory Criteria has been amended to require a reduction in the sample quantity required as part of tender submissions for Separable Portion 3 - Non-Sterile Plastic Aprons, Separable Portion 4 - Procedural Level 2 Gowns and Separable Portion 5 - Backless Long Sleeve Splash Resistant Gowns.

Separable Portion 3, 4 and 5 now only require 3 samples of each product in each of the required sizes to be sent to the nominated addresses.
