Question:
Good Afternoon,

Can you please confirm if the supplier will be required (where appropriate) to implement a Rooming Agreement or a lease with people accessing the service. We understand that each document has different requirements and would like to confirm the departments expectations of which is preferred.

Most appreciated

Dear Supplier

Please see the answer to your question below:

Q: Can you please confirm if the supplier will be required (where appropriate) to implement a Rooming Agreement or a lease with people accessing the service. We understand that each document has different requirements and would like to confirm the departments expectations of which is preferred.

A: In Queensland, Immediate Supported Accommodation provided by a Specialist Homelessness Service often doesn’t involve a formal lease, as the accommodation is typically short-term or transitional. Instead, there is usually a written agreement or house rules outlining the rights and responsibilities of both the service provider and the client. If the client is residing longer term, at 13 weeks, a Tenancy Agreement would be a requirement. Please refer to the Residential Tenancies and Rooming Accommodation Act 2008 for further information.

Thanks,

Question:
The PTM responsibilities section lists what client contribution revenue must cover, and electricity is not on that list. As electricity cost responsibility is silent in the documents, who will be responsible for the electricity costs for the site?

Answered on 12/May/2026 11:35 AM:

Dear Supplier,

Please see answer to your query as per below:

The Crisis Accommodation Program lease for Logan TSA has been uploaded to Vendor Pane for suppliers to review. The lease clarifies that the provider is responsible for electricity.

The funded provider must meet the requirements outlined in Section 5 of the Community Housing Rent Policy - Guideline, which states ‘Providers must comply with the requirements of the RTRA Act and tenancy agreements when applying charges for goods, services or utilities. This includes providers managing Crisis Accommodation Program (CAP) properties when on-charging for gas, electricity, or water charges, even if no formal agreement for these charges is in place’. The funded provider must also meet the requirements outlined in Section 6.2 of the Community Housing Rent Policy - Guideline.

Please note - As per the Social Housing Program Specifications, ‘the funded provider must only use program receipts in accordance with the Allowable Expenditure Policy for funded social housing providers and crisis accommodation providers or subsequent policy as published by the department from time to time, and the funded provider’s funding agreement.’

Question:
Good Afternoon,

1. Entity / Regulatory Status

The ITO requires the supplier to be a Queensland funded Specialist Homelessness Service (SHS) Supplier. The draft Lease requires the Provider to be an Eligible Entity (a registered community housing provider or exempt provider under the Housing Act 2003 (Qld)) and provides that loss of that status is an immediate termination event (cl 8.2).

Can the Department confirm:

1. whether the successful supplier is required to hold CHP registration under the NRSCH, or whether SHS provider status under the Homelessness Program is sufficient to satisfy the Eligible Entity requirement which then entitles the SHS to receive funding from the State under the Housing Act?

2. Noting that clause 8.2 of the Lease provides that the lease constitutes a Funding Agreement under which the State is providing Funding to the Provider, please advise what funding will be provided by the State under the Lease?

3. If the SHS provider is to rely solely on rents collected by clients to fund obligations under the lease, what is the position if those funds are insufficient to comply with the lease’s financial obligations under the lease, which are extensive?

4. Can you please confirm, as per Attachment 1 – Statement of Requirements, under the Out of Scope section, that the Department will be responsible for:

• Property upgrades

• Rates, sewerage and water

• Arranging and paying for rubbish collection.

5. Can the Department provide a definitive list of the Provider’s obligation in relation to asset management. Do the obligations align to the Property lease agreement?

Many thanks

Answered on 14/May/2026 04:32 PM:

Dear Supplier,

Please see responses for your questions as per below:

1. Whether the successful supplier is required to hold CHP registration under the NRSCH, or whether SHS provider status under the Homelessness Program is sufficient to satisfy the Eligible Entity requirement which then entitles the SHS to receive funding from the State under the Housing Act?

Specialist Homelessness Services (SHS) are classified as ancillary housing services under the Housing Act 2003 (Qld) and are not required to be registered under the National Regulatory System for Community Housing (NRSCH).

2. Noting that clause 8.2 of the Lease provides that the lease constitutes a Funding Agreement under which the State is providing Funding to the Provider, please advise what funding will be provided by the State under the Lease?

Yes, the lease constitutes a part of the funding agreement, however the lease must be read in conjunction with the Service Agreement and Funding Schedule.

For clarity, the department will not provide separate funding under the lease, funding for the Logan TSA will be provided under the Service Agreement and Funding Schedule for the provision of SHS under the Homelessness Program.

The quantum of funding provided by the department for the Logan TSA will be determined through the tender process.

3. If the SHS provider is to rely solely on rents collected by clients to fund obligations under the lease, what is the position if those funds are insufficient to comply with the lease’s financial obligations under the lease, which are extensive?

Providers may be approved an exemption from some of their maintenance obligations under the standard lease agreement for department-owned CAP properties. This is referred to as a maintenance exemption. Maintenance exemptions are assessed and approved on the grounds of financial hardship.

4. Can you please confirm, as per Attachment 1 – Statement of Requirements, under the Out of Scope section, that the Department will be responsible for:

• Property upgrades

• Rates, sewerage and water

• Arranging and paying for rubbish collection.

The following services will be the department’s responsibility, and the draft lease will be updated accordingly.

• upgrades, at the department’s discretion

• rates, sewerage and water

• arranging and paying for rubbish collection

5. Can the Department provide a definitive list of the Provider’s obligation in relation to asset management. Do the obligations align to the Property lease agreement?

The following services will be the department’s responsibility, and the draft lease will be updated accordingly.

The department is responsible for rates, sewerage, water and rubbish collection.

The provider is responsible for all other services listed in the lease.

The lease outlines the maintenance obligations of both the provider and the department.

Kind Regards

Procurement team

Question:

Can you please confirm if the Department will be providing on-site security staff?

Answer:

The department will not provide on-site security staff at the Logan Temporary Supported Accommodation.
